NOTARY PUBLIC INFORMATION

Signing Documents

Acknowledgements:
This process is typically applied to documents governing ownership, such as trusts, powers of attorney, and real property deeds. For an acknowledgment to be successfully executed, the individual signing the document must physically appear before a notary. This face-to-face encounter serves the dual purpose of identification and confirmation that the signature on the document indeed belongs to the individual in question. Furthermore, the signer must openly declare that their signature was made willingly and that the provisions outlined in the document are intended to take effect precisely as written.

Jurats:
Jurats are typically associated with evidentiary documents like depositions, affidavits, and interrogatories. To complete a jurat, the individual signing the document must personally appear before the notary. During this encounter, they not only sign the document but also utter an oath or affirmation, solemnly pledging the truthfulness of the statements within the document. It's important to note that an oath represents a solemn pledge to a Supreme Being, while an affirmation is an equally solemn pledge made on one's personal honor. Those who take an oath or affirmation about an official proceeding can face perjury charges if they fail to uphold the truth.

Certified Copies: Authenticating Powers of Attorney
California notaries hold the authority to certify copies of important documents, including powers of attorney. In this notarial act, the notary meticulously compares the copy to the original power of attorney document, ensuring their complete equivalence. To undertake this process, the individual presenting the original power of attorney must appear before the notary in person. Ideally, the notary oversees the photocopying procedure, guaranteeing that the power of attorney and its copy are identical. This additional layer of authentication ensures the integrity of certified copies in legal transactions.
